what are you talking about? i am not suing a bank, i am going to sue capitalone for fraud. your telling me they can steal peoples money and still not get sued? thats funny. we have lawyers and laws for a reason. once i get my hard copy statement, in court they have to tell me where that 2k balance trasnfer came from.
capitalone is ****ting their pants right now, thats why they sent me a 2k check so i would cash it, to make it look like i requested a balance trasnfer. they must be really stupid. they are gonne get it.

They're not s---ting anything. You can't sue them. And they're aren't scared of you or any other loudmouth with a lawyer.
Assuming you don't cash the check the $2000 charge will come off your bill eventually, they *might* waive the finance charges and any past due fees, and that will be the end of it. You won't get damages, you'll never see a courtroom, your lawyer might as well quit now since he has no case. Capisce?
Again, I've been on the inside, I know what goes on (look for some of my other posts to see what else I've disclosed). And the arbitration clause is in there specifically for people like you.

so basically what u are telling me is, capital one can steal anyones money and not get sued? i doubt thats true. they have such rules so they are protected from stupid and non sense claims. but when some **** like this happens, they can be taken to court, or else they can just start stealing ppls money and not get sued for it. what ur telling me is stupid, and i doubt any judge would believe such ****.
and yes you can sue them, the lawyer told me its not that easy and it will take work. i am willing to spend money, time and anything thats required to sue these bastards. i have excellent credit history, i have paid every single of my bills in FULL on time to capitalone, they have no right to **** with me, they are bunch of liars that mess with people. i have conversations recorded where some one tells me i was hacked, and some other guy telling me i requested a balance trasnfer my self. they sure are looking for whats in my wallet, wrost ****ing company.

i don't care as long as they take the 2000 back. they also took my credit privileges away, which i could care less. i want that account closed and they are telling me i have to send in social, driver license, bank statement. sounds fishy to me. i am just going to pay my balance off to these greedy bastards and then leave the account if they won't close it with out me sending them those documents. because they already casued me enough trouble and i am not sending them any documents. soon they will close the account when they see no activity in a 30k credit line credit card.
oh i like how they sent me a letter too "we accepted your balance trasnfer request" lol. they might be able to **** me but they can't cheat me out of my money. i talked to this lady on phone and she said as long as i don't cash it, i am fine and they will cancel the check and reverse the finance charges. life's a ***** and lesson learned.
cap1agent, i also do appriciate your help. don't think i am flaming at you. i am just pissed, any one else would have been if they were in my shoes. any suggestions for future reference if they try to fuk with me? i mena they certainly can't do anything, unless i cash the check.

That's what I expected them to do -- reverse the balance transfer, waive fees and interest, just like they would with any disputed charge.
They need those security checks (photocopies of photo ID, etc) in order to remove the password from the account (otherwise, someone could call in, whine and *****, the password comes out, security breach) Not fishy at all, actually standard procedure. There are certain procedures (password change/removal is one of them) where you have to mail or fax in that stuff.
I should know, I used to get yelled at when either the customer forgot their password or like in your case, another agent retaliated by putting one in. They can yell all they want but I'm not allowed to proceed with servicing the account or else I would be written up for breaching Capital One security procedures. All I can do is give the instructions on how to get the password removed, that's it.
When customers start threatening lawsuits and getting abusive with agents, that's when "stuff happens" and stuff does not mean "bank trembles in fear" like some believe. When I worked for another company (not Capital One, nor was it another bank), the moment a customer mentions lawsuit, we flag the customer's file and just transfer them to the legal department. If they try to call customer relations again, the customer is immediately transfered to legal and will never get customer service again.
Once again the take-home message is, don't be a jerk to the agents, don't be a jerk to their supervisors, and don't ever think you can scare a corporation, especially banks, with legal threats. They will get the last laugh, not you.

is better u stop making any phone conversation with the bank and go just straight to the bank you have you account domicile and figure this out with the help of your lawyer and some good proof that you never mad the transfer.
